WHAT IS NEGLIGENCE? JUDGE’S INTERPRETATION Negligent driving in relation to motor fatalities was interpreted by Mr. Justice Herdman in the course of summing up in a charge in the Supreme Court to-day. “If it is proved that the driver has committed a breach of his duty to the public, he is guilty of negligence,” remarked his Honour, “and if it is proved that this negligence was the cause of death, it would he the jury’s duty to convict. The person who drives a car on the highway is under an obligation to exercise the reasonable care and prudence that an ordinary and prudent and skilful driver would display. If the driver fails to conform to these requirements, and as a result of his negligence .death was caused, he is guilty.
