The Supreme Court was again occupied to-day in hearing the claim by tho Attorney-General, acting for the Mayor, councillors and citizens of Dunedin, against the Arcade Company. The question is whether the passageway through the arcade is private or public property. The present case is a friendly one, and the defendants committed a technical breach by obstructing the passageway to enable tho action to be brought. Old residents of the city testified that barricades in the form of chains or gates were at one time placed in the arcade, and that shop owners who displayed their goods on the footpath in front of their premises were never prosecuted.
