BACKED INTO TROUBLE
LORRY-OWNER TO PAY DAMAGES SEQUEL TO COLLISION (From Ou lr Own Correspondent) TE KUTTI, To-day. Th® sequel to a collision between a motor-lorry and a car near Wairere quarry, on th« Aria Road, on November 22, 1928, was a claim for damages heard in 'the T& Kuiti Magistrate’s Court on Friday. Frank Gould, the owner of the car, claimed from Albert Nord, of Pio Pio, contractor, the sum of .CIS for damage done to the car and £lO general damages and Mrs. C. Watts, an occupant of plaintiff’s car, claimed the sum of £ 5 5s medical expenses as the result of the collision; also £2O general damages. The defendants lorry, driven by Samuel Waewae, it was alleged, was negligently backed into plaintiffs car while the car was stationary. The magistrate, Mr. F. W. Platts, S.M., in giving judgment for plaintiffs, said it was the duty of drivers when backing on a highway ta give adequate warning of their intention to do so. In this case no warning had been given and negligence had been shown by the driver of the lorry, and therefore his employer was liable. F. Gopld was awarded £23 damage*, with costs, and Mrs. Watts £l‘s fcs* with costs £l2 Os 6d.
