A Peculiar Law If law in England is law in New’ Zealand, a most interesting verdict has recently been recorded. It might mean that if every patron of a racing club became a member it could avoid paying taxation. The English Court of Appeal, by a majority, has allowed the appeal of the Holborn Stadium Club, London, from Mr. Justice Rowlatt’s decision in the King’s Bench Division that the club should pay betting tax on made on the club’s totalisator and pari-mutuel. For the club, it was contended that the members merely betted among themselves, and paid 10 per cent, to the club for the services rendered. The Master of the Rolls, giving judgment, said that the Act provided that the tax should be charged on every bet made w ith a .bookmaker. He added that it was quite plain that the bets were made with the club, and honoured by the club, and that it was immaterial whether the system used was the parimutuel or any other, so long as the club was the principal. Therefore he thought that the appeal should be dismissed. Great interest has been aroused in betting circles over the decision. Mr. James Sutters, director of the Victoria Club, told a Press representative: "I take it to mean that anyone can start a club or clubs all over the country, and bet on the totalisator system, without paying the tax, so long as those who place bets in this way are members of one of the clubs. It is a very wide and important decision.” He also pointed out that the Government would have no chance of running its totalisator in the course with 10 per cent, commission, when people could do so iu a club for nothing. The Board of Inland Revenue, it is understood, is considering an appeal to the House of Lords. It is felt that either the decision must be reversed. on appeal to the Lords, or legislation must be introduced to bring such bets within the scope of the betting tax.
