WORDING OF CONTRACT CATTLE SAID TO BE UNSOUND Press Association PAHIATUA, Friday. An interesting stock case, involving the interpretation of the wording of a warranty given in respect to the sale of some cattle, was heard in the Magistrate’s Court, when a claim for £26 10s was. made by C. T. Keeble. of Palmerston North, against F. Ebbett, of Makomako. The magistrate, Mr. J. Miller, said this was a case based on a contract. The wording “all guaranteed sound in their quarters” seemed plain. It did not mean sound at some future date, but at the time of the sale. This clearly brought the onus on t|e plaintiff to show that the cows were unsound at the day of the sale. . In this case, that was not clearly established. A warranty could not be interpreted in any other way than that in which it was written. Judgment was given for defendant, with costs. „ .;?*
