SHOOTING CHARGE FAILS

When Stanley Spencer Hopcrc-tb, aged 22, electrician, Eric Milton Miller, aged 20, clerk, were at the Central Police Court to-day with having shot at Theodore Jamoa O’Brien, on April 7, with intent td rnm-dcu’hini, O’Brien; who, according to the police prosecutor (Sergeant Napper), had identified Hopcroft and Miller at his bedside at the Sydney 'foßDital, said ho could not identify shem to-day. Mr McMahon, S.M., dismissed the charge.
Addressing O’BrieiV, the magistrate said: “In my opinion you are tolling) deliberate lies- At the hospital you told the police that Hopcrofb and) Miller incited Smiley to shoot you, and now you say they did not.” “Here’s a man,” continued Mr McMahon “who ha s been shot down in the street, and some influence has beep brought to bear to keep' lus mouth shut. To Sergeant tapper: Did he mako a statement in writing? Sergeant Nappcr; No. If he had, wo would have known mose about it. Of' course; if ho likes to have bis carcase filled with lead, that s 81 affair.;
