DEFAULTER CLAIMS TO BE AUSTRALIAN

(P.A.) OAMARU, January 28. For failing to report for duty a reservist, George Alfred Dawson, was sentenced by Mr H. W. Bundle, S.M., at the Magistrate’s Court today to one month’s imprisonment and ordered to be detained in a detention camp for the duration of the war. Dawson stated he would not go to camp because he was an Australian and did not intend to stay in New Zealand. Mr J. E. Farrell, who appeared for Dawson, stated that Dawson had appealed on the ground that he was an Australian not domiciled in New Zealand; the board dismissing the appeal for want of jurisdiction. He applied for a permit to return to Australia. This was refused. Dawson came to New Zealand in March 1936. The National Service Department held the view that Dawson was domiciled in this country, but unfortunately no machinery existed to deal with the question of domicile. Asked by the Magistrate if he was prepared to go to camp Dawson replied: “Not in New Zealand,” and was sentenced as stated •
