Auckland. M3B PUBLIC NOTICES INVERCARGILL CITY COUNCIL. PROPOSAL TO DISCONTINUE TRAMWAY SYSTEM. PURSUANT to the provisions of The Tramways Act 1908 and its amendments, notice is hereby given that the Invercargill City Council (being of opinion that the present Tramway System is being run at an ever increasing loss out of all proportion to the value of the service rendered to the public and in view of the age of the rolling stock and the fact that the sleepers and the orginal rails in use are approaching the end of their useful life, which means that a very heavy monetary outlay for renewals is necessary in the near future), intends to apply to His Excellentcy the Governor-in-Council for an authorising Order under Clause 9 of the 2nd Schedule of The Tramways Act 1908, to revoke the Invercargill City Tramways Orders Nos. 1,2, 3, and 4, and to authorise the Council to discontinue the service in such manner as the Council thinks fit and abandon the maintenance and use of the lines and rolling stock and plant incidental to such’’service and to dispose of the same at its discretion. Not later than four weeks after the 19th June 1939 (being the date of the first publication of this notice) any number of persons being not less than five percentum of the ratepayers whose names are inscribed on the Ratepayers Roll of the district, may by writing under their hands delivered or sent by post addressed to the undersigned, demand that the question whether or not such Order shall be applied for, shall be submitted to the decision of the Electors, by way of a poll taken under the provisions of The Local Elections and Polls Act 1925, not less than fourteen nor more than twentyone clear days after the delivery of such demand. If no such demand is made, the Council will, in the prescribed manner, proceed to apply for the Order to revoke and to abolish the present Tramway System in the manner aforesaid.
