CLAIM AGAINST MOTORIST NONSUITED (United Press Association) NAPIER, November 24. “Pedestrians must realize that they also must take precautions in the streets,” commented Mr Justice Blair in the Supreme Court when non-suiting a claim by Arthur Wildermoth against Alick Edward McKenzie for £256 damages. The evidence showed that plaintiff was knocked down by defendant’s car while crossing the street. His Honour said he had no wish to jeopardize the lives of pedestrians, but he must also be fair to the motorist. “This man was crossing the street, metaphorically speaking, with his eyes shut and at an angle that on the evidence of his own witnesses he could see the car in time to avoid it,” said his Honour. His Honour added that it was high time pedestrians were trained to make proper use of the roads. It was a mistaken idea, held by a number of people, that the motorist must necessarily be liable in case of an injured pedestrian and this must be emphasiz- . ed. The case did not go to the jury.
