SUCCESSFUL CLAIM FOR DAMAGES
NEGLIGENCE ADMITTED
(United Press Association) CHRISTCHURCH, May 24. Damages totalling £lO7l 13/6 were awarded to Henry Wensley Piper, a retired confectioner, aged 76 years, in the Supreme Court today for injuries suffered when he was knocked over by a motor-car in a city street. The defendant in the action was Mrs Annie McKenzie, wife of John Robert McKenzie, a merchant, of*Chiistchurch. The accident occurred on March 7, 1936, in Colombo street, near Armagh street, the car driven by Mrs McKenzie colliding with plaintiff, who was walking. One of plaintiff’s legs was broken and he claimed he was caused much pain and suffering. The claim for £1250 general damages and £l2l 13/6 special damages, making the total amount £1371 13/6, was heard before Mr Justice Northcroft and a jury. Plaintiff alleged that the accident was due to negligence on the part of Mrs McKenzie. Her liability was admitted and the jury was asked to concern itself solely with the amount of general damages. The claim was brought against Mrs McKenzie’s separate estate. The jury awarded plaintiff £950 general damages.
