MAGISTRATE’S COURT
THURSDAY (Before Mr W. H. Freeman, S.M.) Judgment was given for plaintiffs by default with costs in the following civil claims:—Holloway Brothers Ltd. v. Harold Perry (Invercargill) for £2 13/-, costs £1 5/6. Possession Of An Engine Andrew Cunningham, of Nightcaps, engine driver (Mr J. C. Prain) proceeded against Charles Trow, of Riverton, fisherman (Mr Gordon J. Reed) on a claim for £3O. Plaintiff claimed possession of a four horse-power marine engine valued at £3O alleged to have been detained by defendant. Alternatively the plaintiff claimed £3O in case possession could not be had and £5 damage? for detention. Plaintiff alleged that he had left the engine in the possession of defendant and some time later he asked defendant to send it to an Invercargill garage. Defendant had told him that the engine had been lost at sea in the launch Viking. Plaintiff had subsequently learned that the launch had been sold before the wreck. Defendant alleged that plaintiff informed him that he was finished with the engine and that a former owner in Dunedin might claim it. If he did not defendant could do what he liked with it Defendant said he handed it over to a Bluff engineer on the same understanding. Decision was reserved.
