ACTION FOR DIVORCE
FORMER NEW ZEALANDER. QUESTION OF DOMICILE. (United Press Assn.—Telegraph Copyright.) (Rec. 7.5 p.m.) Sydney, November 1. Mr Justice Boyce in the Divorce Court in Sydney was asked to determine questions of jurisdiction and domicile arising out of a petition of Lionel Clifford Brierley, a former New Zealand racehorse owner, who now describes himself as a factory manager of Darlinghurst. Brierley is seeking divorce on the grounds of desertion by his wife, Eva Brierley, now residing at Auckland, who has forwarded a reply to the petition. Mrs Brierley’s affidavit states that her husband deserted her about 1927.
Mr Justice Boyce held that the petitioner’s permanent home is here and he possesses the requisite domicile qualifications. Mr Justice Boyce gave the wife two months to file an appearance.
