KISCH CONVICTED
SENTENCE DEFERRED.
(United Press Assn—Telegraph Copyright.) (Rec. 8.35 p.m.) Sydney, January 21. Kisch was convicted of being a prohibited immigrant and sentence was deferred until to-morrow. Following Kisch’s conviction by the police magistrate, Mr Shepherd, an application was made to Mr Justice Evatt in the High Court, for a rule nisi restraining Mr Shepherd from proceeding further. Mr Evatt declined to deal with the application until the completion of the police court proceedings to-morrow. Mr Evatt, however, granted a rule nisi calling upon the proprietors and editor of the Sydney Morning Herald to show cause why they should not be committed for contempt of court respecting the publication of matter tending to prejudice Kisch at the recent police court proceedings. Argument on this matter was adjourned till January 29 owing to the absence of the Herald’s leading counsel.
