ELECTION OF MAYOR DEMOCRATIC CANDIDATE CHOSEN POLLING NEXT MONTH (United Press Assn.—Telegraph Copyright.) (Rec. 7.20 pirn.) New York, October 6. Litigation following the resignation of the Mayor, Mr James Walker, resulted in the Court of Appeal’s decision to-day. that the new Mayor must be elected on November 8 at the same time as the national elections. Tire New York City Democratic Convention to-night nominated as surrogate Mr John P. O’Brien, who is the choice of Tammany Hall over Mr Walker or the acting Mayor, Mr McKee. The decision followed a bitter fight involving national politics. At the last minute Mr Walker, who was en route to New York aboard the Europa, cabled withdrawing his name, partially because he was in ill-health and partially because he desired to avoid embarrassment to the national ticket headed by Mr Franklin D. Roosevelt. Mr Roosevelt’s friends at the convention agreed to Mr O’Brien, but indicated that they would fight Mr Walker, whose name brought thundering applause from 3200 delegates, causing the leaders to predict that he was likely to be a candidate at the 1933 elections.
It was announced on September 3 that Mr Walker’s resignation was the culmination to the Hofstader Committee set up to probe into civic administration and the hearing by the Governor, Mr Franklin D. Roosevelt. In a formal statement accompanying this resignation Mr Walker said he was submitting the case to the people of New York in offering himself for reelection. Though there were many rumours that such action was impending, Mr Walker’s resignation nevertheless caused a sensation and hurled the city’s affairs into a turmoil considerably confusing the national political situation.
