INJUNCTION REFUSED
TRADE NAMES OF TAXIS.
ALLEGED SIMILARITY.

Christchurch, December 10.
Reserved judgment in favour of the defendant was given by Mr Justice Adams yesterday in the case in which Charles Seymour Trillo asked for an injunction restraining William George Dix from using the word "Gold” in his trade name, Gold 1 Crown Taxis. The plaintiff is proprietor of the Gold Band Taxis. His Honour said that the advertisement printed in the Christchurch Star read: "Who are the Gold Crown Taxis? Why exGold Band drivers on their own ’Phone, 37-755.”
“It is in my opinion,” declared his Honour “a clear statement that the defendant anti his associates are carrying a business of their own under that name entirely separate from the business of the plaintiff. Defendant’s window sign is clearly visible and the crown is prominent and must strike the eye of persons looking at the sign. There is no evidence that anyone has taken the sign for plaintiff’s and I do not think any intelligent person would so take it.”
