They also charged Philip .Stewart and James Heffernan with assisting to conduct a common gaming house. The police stated that the charges referred to two dates, one being April. 12 and the other May 10. As to the former case, evidence had been collected by Plainclothes Constable Dunn,, of Christchurch, who deposed to having made bets with defendants. Evidence as to the second series was the result of a police raid. Defendant’s counsel, Mr Hannan, objected to taking the cases together, arguing that the evidence as to one date was not admissable in the case of the other.
The Court decided to take the cases separately. The evidence against McCarthy on both counts was completed, decision being reserved. ,
The evidence against the other three on the second charge will be heard to-morrow, while that against Hassall as to April 12 was heard to-day, decision also being reserved.
