GAMING ACT
CONVICTION UPHELD. (Per United Press Association.) Auckland, October 16. The conviction by Mr F. K. Hunt, S.M., of Edward Wilerson Waren, of an offence under the Gaming Act in connection with “the exploitation of scientific totalisator speculation,” was sustained by Mr Justice Smith at the Supreme Court, an appeal having been made on a point of law arising from the sending out of circulars. Appellant’s contention was that the circular related only to the totalisator investments, and that they were a legal form of investment. The Judge upheld the Magistrate’s finding that the intent included intent to induce application for advice not merely as to investments on the totalisator, but as to future horse races, otherwise than by investment on the totalisator, and that the advice was of such a nature as to necessitate the employment of an agent contrary to the provisions of the Gaming Act.
