SENTENCE REDUCED
MOTORIST’S APPEAL. CHARGE OF NEGLIGENT DRIVING. (Per United Press Association.) Auckland, September 3. An appeal by Joseph Mercer from a setnence of one month’s imprisonment imposed by Mr Hunt, S.M., for negligent driving, which resulted in the death of one passenger and injuries to two others near Papapura on January 22, was heard to-day by Mr Justice Herdman in the Supreme Court. /
His Honour refused an application to substitute a fine for imprisonment, but reduced the sentence to 10 days. He was particularly impressed by the evidence of appellant’s employer as to Mercer’s good character, and by evidence that he was perfactly sober.
