MAGISTRATE’S COURT
CIVIL CASES HEARD. A sitting of the Magistrate’s Court was held in Invercargill yesterday morning before Mr George Cruickshank, S.M. UNDEFENDED CASES. Judgment was given for plaintiff by default in each of the following civil cases—• Bray Bros. v. R. S. Corkin, £l9 14,/2 and costs £1 3/-; James Lilico v. Charles A. Maule, £lO 10/- and costs £3 9/9; J. H. Johnstone and Co. v. J. Mitchell, £l3 and costs £2 14/-. JUDGMENT FOR PLAINTIFF. Matthew Lawson Fallow (Mr Gordon Reed), farmer of Fortrose, proceeded against John Kennedy (Mr Eustace Russell) to recover the sum of £2O for the use of a paddock for grazing purposes, while defendant was engaged in carting timber for a mill there and also for an additional £1 for damage dftne to a gate on the property. Defendant entered a counter claim for the sum of £45, £25 of which was claimed in respect to 500 posts which plaintiff was alleged to have taken from defendant’s property some five years ago, and also £2O for carting done from time to time on plaintiff’s behalf.
A good deal of evidence was heard on both sides, after which his Worship entered up judgment for plaintiff for the sum of £l6 18/“, together with costs and other expenses amounting to £7 2/-. The counter claim was dismissed. DECISION RESERVED. Arising out of a motor collision which took place some time ago, Patrick Brosnan proceeded against Alexander William Pettigrew for the recovery of damages sustained. At the conclusion of the evidence his Worship reserved his decision.
