LOSS OF FURNITURE
AN INTERESTING POINT. (Per United Press Association.) DUNEDIN, November 16. At the Supreme Court to-day before Mr Justice Sim, John Steward Wilson sued the Express Company .for £1315 12s for loss of furniture and effects. The facts were that defendant company contracted with the plaintiff to forward plaintiff’s furniture from Oamaru to Whakatane. The furniture was sent from Oamaru to Auckland and stored there for some months at the request of plaintiff. It was then forwarded at plaintiff’s request to Whakatane by the steamer Tasman, which was wrecked and the furniture lost. The question for the Court to decide was whether, on the assumption that the wreck was due to carelessness on the part of the captain and officers of the vessel, the Express Company would be liable for damage. His Honour said he would take time to consider his decision.
