ALLEGED NEGLIGENT DRIVING
A COACH PROPRIETOR SUED In the Magistrate's Court yesterday morning, before Mr G. Orulckehank, S.M., Ernest Kelland, labourer, of Awarua Plains, on behalf of his infant daughter Elizabeth Kelland. claimed from Daniel Kurle, coach proprietor of Fortrose, £6O damages, for personal injuries sustained by her In a trap accident on the Slope Point-Waimahaka road, on February 13, 1916, and also a further £ls on ids own behalf, to cover medical, nursing, and other . expenses. Mr .1. F. Lillicrup appeared for plaintiff, while Mr Eustace Russell defended. The case for the prosecution was that the child, Elizabeth Kelland, sustained her injuries (two broken thighs) by being Jolted from a cart owing to the negligent driving, through, a muddy gateway and on to a rough (Informed road, of one of defendant's employees. The defence was that the jolting was insufficient to throw the child from her moth'er’s knee had she been firmly held. After a particularly lengthy hearing, in which some very contradictory evidence was given, his Worship reserved his decision.
