Burke was then at homo, hut accused returned to the house later when Burke was out and committed the theft. lie denied all knowledge of the charge when first seen by Detective Cameron, hut had since admitted having committed it and nine pounds had been recovered. ■ lolm Burke, a resident of Kttrick street, gave evidence, the effect of which was that accused was his grandson and frequently visited his house. When leaving his house on Saturday night he Ricked the door and hung the Key on a naii outside, which repository was known to accused. On returning some time iuter lie found the door open, his trunk was open, and a hag containing twelve pounds had been stolen. Francis A. Clark, a small liny, said that ho haii accompanied accused on his round on Saturday and that he called at Burke’s house on his way to South Invercargill. On their way back from South Invercargill accused went into Burke’s place again, and after remaining in for about ten minutes came out carrying a bay like the om- produced in Court. A ecu se»l was committed to the Supreme Court for sentence. The case was mentioned in the Supreme Court yesterday afternoon when Mr W. Macalister. Crown Prosecutor, asked his Honour if the prisoner could be brought up to-day. His Honour said that lie would deal with the case at ha_L£ past ten to-day.
