(Before 0. A. Wray, Esq., R.M.) ' CIVIL OASES, In the cases J. Shaw v. Macintosh, and cross-action Macintosh v. Shaw. Mr Hay appeared for Shaw, and having explained that the omounts in dispute between the parties arose over the training and racing at the last Timaru race meeting of a horse called Zero and the sale by Shaw of one called Lightfoot to Macintosh, Mr Hay asked that the clerk of the court take down the evidence of Mr Maloney and Mr .Shaw for transmission to the court at Papanui. where Macintosh resides. This was done, Shaw stating what amounts had passed between the parlies. Priest and Holdgate v. Bussell, claim IBs lOd.
Mr White for the plaintiffs, and Mr Hay for the defendant. This was one of the cases heard last court day in which a portion of the claim was for interest, which interest the defendant had not agreed to pay. There was a notice on the billheads that interest would be charged. His Worship took time to consider the point, and this morning said that he would decline to allow interest. South Canterbury Hospital and Charita’de Aid Board v. Maria Fitzgerald, claim £74 15s. This case was partly heard last court day, and fully reported, so that the circumstances are known to our readers. Mr Perry for the plaintiffs and Mr "Raymond for the defendant. The evidence of Morris Moore and Mrs Fitzgerald was heard, and counsel then addressed the court.
