WELLINGTON, June 12,

An important action was begun in the Supreme Court this morning—Maaawatu Railway Company v. Queen. The company claim that part of their contract with the Government was that any block or portion of a block of land in the vicinity of the line, acquired by tho Crown within a period of five years from March 1882, should be set aside as an endowment to tho Company, provided the value did not exceed £29,805. But tho Government sold by auction a portion of tho ilorowhenua block, comprising 30,088 acres. The company seek to bo pub ia a position to prosecute its complaint in tho court, and take such proceedings us are necessary. The contention of I he Crown is that Horowhonua block was not acquired till June 19th, 1837, and consequently not within the five year limit.

Judge Williams gave judgment in the case Auditor-General v. Mariiototo County Council. He sees no reason why a county council should not vote a reasonable sum for travelling expenses, and are empowered to pay them. If the council consider a fixed sum per mile sufficient he sees nothing in the Act to prevent it. He thinks the Act of 1873 intentionally framed to enable county councils to do what the Maniototo has done, and so avoid unseemly discussions which inevitably take place if the reasonableness of every item of individual members’ expenses had to be discussed. lu the Westport Company v. Queen, the Judge held that steel coal tubs on which duty had been claimed were as much a part of the mechanism for drawing solid matter from the mines us the piston and valves for the mining pump are for lifting water, and therefore shoeld be admitted free. In the Qullie will case application is being made to tender froth evidence.
