INFORMATION DISMISSED.

Mr J L Stout, T S.M\, gave judgment at Marton Court yesterday in the case Inspector of Fertilisers v P J Sladden. This was an information under section 17 (o) of the Fertilisers Act, 1908, charging defendant, P J and Siadden, as manager of Abraham Williams, with an offenoe against that section, Mr Ladley for defendant had raised the preliminary objection that the information should have been against the company and not against the defendant personally. His Worship thought this objection must be sustained. The company was the vendor of the fertiliser and as such was liable. Defendant was merely a servant of the vendor and was not by the 'Act made criminally liable, The information would therefore be dismissed.
