AN INTERESTING CASE.

A case of interest to cheese manufacturers has been heard at Woodville. Samuel Baird, Ashhurst, cheese factory manager, sued the Tararua, (Balance) Co-operative Dairy Factory Company for £24 13s 4d, claimed to he due partly as wages earned, partly as a mouth’s wages in lieu of notice, and partly as the value of perquisites to which he would have been entitled had he remained in the defendant company’s employment until the expiry of the month’s notice to which he claimed to he entitled.

Mr W. A. Lyon appeared for plaintiff, and Mr d. Harold Smith, of Pahiat-ma, for defendants. ** Mr Smith raised a preliminary objection. The plaintiff sued on an agreement between himself and the company and the last four lines of the agreement provided that, in the event of any dispute it must be referred to the dairy inspector for the district whose decision both parties were bound to accept as final. He Mr Smith, therefore submitted that the Court had no jurisdiction.

Mr Lyon said lie was perfectly aware of the clause in the agreement to which Mr Smith had referred but he submitted that it could not be held to apply to a financial dispute after the relationship of master and servant between the parties had ceased to exist. His Worship upheld the point raised by Mr Smith and non-suited the plaintiff with costs £1 Js.
