THURSDAY, MAY Bth. Before Mr W. Kerr, S. M. DRUNKENNESS A first offender on a charge of drunkenness was convicted and discharged. He consented to the issue of a prohibition order. LEVEL CROSSING OFFENCE. S. H. Prince was charged with riding a motor cycle with side oar attached over a railway level crossing when a train was within half a mile of the crossing. Mr Collins appeared for defendant. The police stated that shunting operations were proceeding and defendant passed just in front of the engine. It was pointed out that there were numerous accidents arising from the same source, although they did not always appear before the Court.

Evidence was given by Shuntei Small that he saw Prince first about four or five chains away. There v»ere 26 vehicles ami an engine, and it was about 30 feet off the crossing. The train was travelling four or live miles an hour and gathering speed. He called out “Look out!” when Prince was about a chain away and Prince looked up. •

In answer to Mr Collins, witness stated that the train was moving when Prince came in view. It was the custom to whistle at crossings when shunting, butdie was not sure that the whistle was*”blown -on this occasion. Plaintiff wag travelling about 10 or 13 miles an hour when he crossed. It would not be safer to cross at that speed than to stop. His Worship pointed oat the numerous accidents arising out of neglect of this kind. The Legislature looked upon such cases as serious and the utmost care should be exercised by the travelling public. It was only natural to try to put the blame on the railway officials, whereas if the public exercised only ordinary care accidents would be avoided. The case, no doubt, was brought to focus this in the public eye. Although t b is was an Isolated case similar cases were common. Judge Dsnniston has said that people with such great potentialities for mischief as motors and who have the means of controlling them should exercise the greatest care on the slightest suggestion of danger. The case was brought in the public interest and as a warning. Defendant was convicted and fined £l, with costs 15s.
