Judge Heydon was appointed a Royal Commission to inquire into the case of the man Russell who was dismissed from Kembla colliery. Counsel for Russell sought to obtain a ruling amending the Industrial Act and fixing special rules for the Southern collieries. Judge Heydon thereupon threw up his Commission, declaring that counsel was seeking to make him a peg whereon to hang matters which were not intended. As a Judge of the Arbitration Court he considered it his duty to get as tar from politics as possible.
