SIR WALTER BULLER’S ESTATE.

Justice Cooper gave judgment today in a case relating to the estate of the late Sir Walter Bailer. - The Crown was plaintiff and defendants were Messrs W. Lt. Bailer and Gilbert Mail', surviving executors of the will of the late Sir Waiter li. Bailer, barrister, and Messrs A. L. Herdman and, H. E, Anderson, executors of the will of the late Arthur P. Bailer. The Crown claimed that in 1893 Sir W. jj. Bnller transferred to his sons, W. L. Bailer and A. F. Bnller, land at Manakau, Wellington district, for £3OOO, the real value of which at that time was £4000; further that £3OOO was never paid. Tbe Crown claimed as duty £3OO and a fine of 100 per cant. The Court held that no part of the £3OOO was ever paid, and that the statement in tbe deed of transfer was false. The Jadge found farther that the land was of greater valae than £2OOO, and that a memorandum to secure payment of £6OOO was apparently given by the sons. There was no evidence relating to it, and that-Sir' Walter Bnller treated It as nonexistent for .some time prior to his death, that in his will he treated it as a free gift to his sons. His Honor found it impossible to believe chat the transferees were bona fide purchasers. That was the substance of tbe transaction and however Sir Walter Bnller tried to disguise it, it was a gift to his sons. Judgment was given for the.. Crown for £4OO.
