Judgment was delivered by Judge Edwards at Auckland to-day in the case in which the Ford Shipping Line appealed against the decision of Mr Kettle, S.M., in the case of appellants against the Superintendent of the Mercantile Marine, arising out of a provision in the Shipping and Seamen’s Act, which states that when a seaman on a Home or Intercolonial trade ship is left ashore by reason of accident or sickness the master shall deposit .the wages due and sufficient to cover costs of maintenance and attendance in the public hospital. Id this case an injured seaman went to a private hospital. Appellant therefore claimed refund of the deposit with the exception of wages due. Jcdae Edwards said the appellants contended hno seamen could benefit by the s»*-tato unless he became an inmate of the public hospital. The contest really turned on whether any deduction could be made under the heading of medical and living expenses. The Judge held that this was fatal to the appellants who knew that the Superintendent intended to hold them liable for medical and living expenses, and added that the clause was so illworded that the Marine Department shonld obtain a conclusive adjudication from the Court of Appeal.
