AN EXTRAORDINARY CASE.

An actioo for slander, in which one of the parties was an ex-Dunedin resident, was tried at Adelaide last month. Henry Male and wife sought to recover £4OO damages from David M‘Namara for saying that he was living with a woman who was not his wife, and that he harbored prostitutes. The plaintiff, who is a cab proprietor, in the course of his evidence, made some remarkable statements, to wit: —“ The person who married me was a gentleman I often used to drive. I did not broach the subject to him myself. A Mr Brooks did the job for me. I put him up to it. Brooks said he knew Dr Stuart|and would get him to marry us. I should not know Dr Stuart now if I saw him. I found out afterwards that Brooks played ‘ a little game’ on me. I was determined to have the present Mrs Male by fair means or foul. I never induced a person by the name of Stuart to represent himself to be a Scotch clergyman for the purpose of marrying us. [ln an affidavit filed in the case he swore that he did]. I did not want Mrs Male to know that she was not my lawful wife. I do not know now that the man who married us was not a Presbyterian minister. My present wife never knew that she was not my wife till this case. I used to give my previous wife enough to live away trom the house. I had two wives living within a mile of each other. Mrs Male gave me something like a certificate to take to Mr Mouat, a solicitor.” Plaintiff was nonsuited on the ground that the alleged slander had not been proved. It is likely that a prosecution for perjury will be directed against Male.
