(Before Jas. Booth, Esq., 8.M.) Monday. John Doyle was fined 5s for drunkenness. Samuel Boyd was charged with being ip enclosed premises without lawful excuse.—Prisoner, who pleaded guilty, said he was under the influence of drink, and did not know where he was or what he was doing.—The prisoner, who is well known as a most inoffensive and honest man, received an excellent character from Mr J. Erskine, and was sentenced to fourteen days’ hard labor. Tuesday. File v. Winstone.—Claim ns 3d; judgment by default. File v. Sinclair. —Claim £2 8s 2d ; judgment by default. Bqurke v. Francis.—Claim Z-l 48 on a judgment summons ; ordered to pay /2 per month. Wednesday. A deaf and dumb Native boy, named Aparama, was brought up charged with stealing an axe and a quantity of maize, the property of J. Campbell, Makauri. —Some difficulty was experienced by the Court as to how the evidence should be interpreted to the prisoner and the aid of the bay’s mother had to be sought.—The first charge being substantiated the hoy was sentenced to thirty days hard labor. I It appealed from the statement of Mr i Rees that the plaintiff and defendant I w«ye engaged on a contract together op the Pakarae Road, and that an implied copthaet was entered info, but a disagreement having arisen the plaintiff demanded xos per day.—The plaintiff gave evidence to this effect and stated that defendant admitted a partnership in the Tologa Bay contract, but denied the partnership in the Pakarae one.— By Mr. DeLautour : Hail received the credit items by cheque and some small items in cash, whilst other items were for clothing got from the stores, Could not say exactly whether the item of £7 was for board.- “Now remembered thaf it was for board at Tologa Bay. The last/b was after settling up. I took the £2 to get away from Gisborne. I did not get £2 at Tologa Bay. Some of the workmen got /1, some £1 10s and some 8s per day. I kept the time. The deposit money and everything was paid in Mr Corcoran’s name. Received a letter (produced.) Began the Tologa Bay work on the Thursday. Cocoran had /’zo on his contract offered him. I advised his acceptance, but he did not take it.
