MR. "X" VANISHES
REPORT TO FULL COURT LEGAL INVESTIGATION SYDNEY, May 7. The Full Court was informed yesterday by counsel for the Incorporated Law Institute that a Mr. "X," whose alleged malpractices in association with a solicitor were mentioned last year, had decamped from the jurisdiction of tho court and that it was unlikely that ho would return.
It was claimed previously by the institute that the solicitor (designated an attorney) and Mr. "X," who is not a member of the legal profession, had carried out legal work for profit, and to meet the difficulties connected with hearing the two cases together the court was asked to invoke an old English Statute of 1749. which is in force, in New South Wales. On that occasion, the court held that some difficulty might bo experienced in considering the 'case of Mr. "X" under the. old statute, and tho application was allowed to stand over generally. Yesterday counsel for tho institute, after stating that no further action would bo taken against Mr. "X," asked for, and was given, leave to refer tho charges against tho solicitor to the Statutory Committee of the Incorporated Law Institute for hearing. Affidavits were read setting out throe charges of practising without a certificate, and two charges of misappropriation against' tho solicitor.
It was alleged that while not being certificated the, solicitor had appeared in a matter before the Quarter Sessions, that he had filed a statement of claim in the Equity Court, and that he had acted in a conveyancing matter. An affidavit by the secretary of the Incorporated Law Institute sot out that the case of the King v. Mr. "X" had been in the list for hearing of the Quarter Sessions.
