ALLEGED INTOXICATION

SEQUEL TO PROSECUTION

At about midday on Wednesday, John Franklin, of Ocean Beach, in the Hastings court and was fined £ls. and his driving license was cancelled for 12 months, on a charge of being found in a state of intoxication whilst in charge of a motor car. At about 3.20 o clock on the same day, the same man was arrested, and before Mr. I' 1 . 0, Wilkinson, he was charged yesterday morning with again being found in a. state ol intoxication whilst in charge of a motor ear. During the hearing of the previous case, Mr. .1. Miller, S.M., intimated that the. time had arrived when the only alternative for motorists charged with this offence was a term in prison, and he stated that had the defendant been charged with his offence at a later (late than the original charge, he would nothave hesitated to'deal with the case with other than a fine. , “In view of the fact- flint this man was before the court on Wednesday on a similar charge. I think the case is one. which should he dealt- with by the magistrate,’' said Senior-Sergeant Sivyer, in asking for a remand until Wednesday next. Tho application for the remand was granted, and in asking lor bail, Mr. M • p. Bate, who appeared for the defendant, said that defendant had taken out a personal order for prohibition, and until the case was heard, he would ho kept on his small dairy farm at Ocean Beach. The senior-sergeant: I do not oppose the granting of bail, but I would like tho defendant to understand that he must not drive a car under any consideration. . Mr. Bate: He has no license to drive, this having been cancelled, and lie has also signed over the motor vehicle to his wife, so lie has now no control whatever over it. The Bench: Well, he. will be very foolish if he drives it. again. Bail was allowed in the defendant .or £SO and a surety of a similar amount.
