CONTROLLER FINED £IOO AUCKLAND PROSECUTION (Per Press Association.) AUCKLAND, this day. In the, Police Court yesterday, Mr W. R. McKean, S.M., delivered .judgment in a ease heard, the previous Friday inVhieh 'Clarence William Bussell was charged with using premises in His Majesty’s Arcade as a common gaming house and, alternatively, with assisting in the management of a common gaming house. : The magistrate said Bussell was the Occupier of Boom 12 in His Majesty’s Arcade' and it was admitted- that he was formerly the. occupier of Boom 16 for the purposes .of . gaming in the same building. He. was now charged in connection with Boom 10, in respect of which two other men were recentlyconvicted. Mr McKean considered that the facts produced by, the. prosecution were sufficient to show that defendant was acting as the person having control of Boom 16, and he therefore must be convicted. Bussell was fined £IOO for being the occupier of the premises. Counsel asked the magistrate to fix security for leave to appeal, Mr McKean replying that this application should be made in the ordinary way.
