INSTRUCTOR LIABLE CLUB NOT INVOLVED (Per Prrsa Association.) WELLINGTON, this day. Ait aeroplane propeller and aeroplane dope acquired by G. A. C. Cow per, a flying instructor, in the name of Whangarei Aero Club was held by Mr. W. F. v stilwell, S.M., in a reserved judgment, to be a liability against him alone in a case in which Gilbert Lodge and Company sued Cowper and W. T. Surman, an accountant, of Whangarei, as the secretary of the Whangarei Aero Club, for £l6 4s 6d. Mr. Stilwell reviewed the facts, which were that Cowper interested people at Whangarei in the formation of a club and carried on with his own aeroplane, flying and teaching under an arrangement whereby he acted as a free, lance. The goods were forwarded to his order in the name of the club, but Surman repudiated the account. Mr. Stilwell said there was evidence of unbusinesslike methods, but no evidence establishing liability on Surman. Judgment was against Cowper by default, and for Surman.
