REGISTRATION SUGGESTED GAUGING OF STANDING “There is no statute that makes it obligatory, for persons in partnership or otherwise trading under a business name to register,” said the lion. G. J. Garland, speaking at a meeting of the Institute of Certified Secretaries in Wellington. “There exists in England an Act that makes it necessary for any person or persons trading under other than their own names to register. This Act is known as the “Registration of Business Names Act.” In Australia the same conditions apply under the Registration of Firms Act. If both these countries enact- such legislation,” added Mr. Garland, “then there is some profound reason for it. Possibly it may he that these Acts are designed for the benefit of creditors of such persons who trade under an assumed business- title. If this is so, then 1 think that this legislation is very commendable in that it serves the public and traders who may before granting credit inquire at the registrar’s of the names of (lie persons so trading under assumed names. The financial standing of such persons may then be gauged and credit given or not according to the ascertained worth of the individual concerned.

“The Government might seriously consider any representations you may make to them in this connection, for undoubtedly it would mean additional revenue to them in the nature of registration fees which at this time would be a welcome addition to the official coffers. The matter was one which the council of the institute should discuss.”
