f Herald Correspondent.) All the. country north of the Waihua River is now a beautiful green hue, and. given another week, in the borough outskirts there should be plenty of feed for the winter. A case of considerable interest to all Wairoa local bodies was recently heard at the Magistrate's Court in Whangarei. Hie Whangarei County Council sued the Slate Advances Department as first mort-
gagee' for rates on lands over which the lepartinent held a mortgage. It was admitted that the department was the first nortg;;;;,ce and that i\w rates were duly struck. The defence was that the superintendent of the department was the Crown, in this case, and therefore exempt from rates, except special rates levied before ho became a mortgagee. I'he plaintiff council claimed that the superintendent was not the Crown, but i corporation distinct from the Crown. !t was admitted that if the defendant's (intention was right the council could not recover rates until the mortgage to he superintendent is satislicd. Decision was reserved.
