INCONSISTENT PENALTIES' MAGISTRATE' S REPLY (Per Press Association.) CHIMSTCHUEUH, this day. Criticism by members of the Automobile. Association regarding the incon-. sistency in the penalties imposed for breaches of traffic by-laws were replied to by Mr. H. A. Young, S.M., to-day, in a statement from the Bench. He said it was not easy for a magistrate to arrive at the punishment that should be indicted as many factors had to be considered. All that was in the mind of a magistrate .when iixing a penalty, wasi not always stated by him. That something could be said for the magistrate's point of view in regard to speeding was, borne out by the fact that when addressing Grand Juries in Auckland, two judges had said that the statute law and local by-laws were adequate to prevent such cases arising, , and that more substantial penalties should be imposed in the police courts to enforce their observance. While, as a motorist, His Worship thought that several by-laws should be altered to meet new conditions, he could not, as' a magistrate, declare any of the bylaws unreasonable without this defence being raised. , I
