SECOND EDITION. PRISONER’S APPEAL
SUPREME COURT HEARING ALLEGED UNJUST SENTENCE (Per Tress Association.) AUCKLAND, this day. Mr. Justice Herdman heard argument on an application lor a writ of habeas corpus in the case of William George Cavenett, sentenced by Mr. F. K. Hunt, S.M., to two months' imprisonment on one charge, and one month on a second, in the course of which the Judge remarked to Mr. McVeigh, for the applicant: You say that the magistrate penalised the man, not because he sold an axe, but because he \ras going to appeal. Mr. McVeigh : Yes, that is just what it is. He moved that the prisoner be discharged from custody, and that a rule nisi for habeas corpus be granted. After hearing Mr. V. R. Meredith, who submitted that the magistrate's action was quite proper. His Honor said he would take time to consider the matter.
