MISREPRESENTATION ALLEGED

PEDIGREE FROM MYTHOLOGY

An interesting claim, before Mr. Justice Stringer and a jury of twelve, occupied two days. lt» was one in which Henry Zimmerman, a Swiss set,tl«i" at Okopaki, sued Henry Dowdall, caretaker of the Government farm at Piu, Kopaki, and Michael Joseph Galvin, Crown Lands Ranger, Taumaurmii, for £550 on account of an alleged misrepresentation on the sale of a 'grade bull which was allegedly sold as a pedigree animal. It was shown in evidence that plaintiff had a Jersey herd of 64 cows and wanted to improve his butter-fat returns. He saw Dowdall, who, according to plaintiff, said that he had a good pedigree Jersey bull, and this was finally purchased by plaintiff for £23. He allowed it to run with his cows, and it proved a failure. Plaintiff then pressed Dowdall for the pedigree, and. finally, some months later, Dowdall gave him a list, which, he said, he had received from Calvin. A letter was also read from Calvin authenticating the pedigree and asking for 2s 6d search fee, adding that Zimmermann had got a "snip." AN ANCIENT PEDIGREE. The alleged pedigree contained a long list of names from famous Greek mythology, ancient and modern history, poetry, politics, fiction, such as (sire and clam) Jupiter-Venus, A hah-Jezebel, Mark Anthony-Cleopatra, Raleigh -Elizabeth, Napoleon-Josephine, lvanhoe-Bride of Lamniermoor. Rob Hoy-Joan of Are, Copperlield-Little . Dorrit, Sherlock Holmes-Lady Watson, Lloyd GeorgeSylvia, Pankhurst, Oscar Wilde Lady Windermere, Eugene Aram-Maid of Perth, and many more, the list admittedly being drawn up by Calvin, who, in defence, declared it was a joke and that it was regarded as such by all parties. It was only given to plaintiff twelve months after the purchase of the bull.

Dowdall's defence was that the bull was never sold as a pedigree bull, and plaintiff inspected the bull and himself took delivery.

The jury found no fraudulent misrepresentation by Dowdall, but that Galvin intended the pedigree to be acted upon a.s though it was genuine.

Plaintiff was awarded £36 damages against Calvin. A nonsuit point raised on Calvin's behalf is to be argued.
