A NOVEL POINT.
GL AT M FOR M A LNTENAN(! B. PLIGHT OF A CRIPPLE. | An unnsually novel point was raised in a easo under the Destitute Persons Act, by Mr. E. C. Levvey. S.M., in the Gist--borne Magistrate's Court this morning, itbeing held that the possession of a house property was an effective debarment to a claim'for maintenance under the Act. Th.i action was one in which a cripple, with a wife and family to support, proceeded against five relatives for a contribution towards his maintenance. It was shown that when the complainant's father died, various substantial S'-tms hnd been bequeathed to all the children with the exception of complainant, who was left a house valued at about J3EOO. During considerable legal argument it was shown that there was no reported decision in a previous similar action, and the Court held that the complainant, in view of his possession of the house, was not destitute within . the meaning of the Act, and that no relief, therefore, could be granted.
