Some linje ago the Mangapapa Town Board wrote to the Municipal Asßopiatiofij asking for a legal opinion as <to the Town -Board's position' in> reßpect' to the ; extension . of • the - tmnlway servipe from the Borongh boundary t6 Bell's store, 'and whether the Board could bor-^ row for the purpose. * The following, reply was received': — "1. I regret. that heavy workjirivconnection with the. approaching < Municipal Conference has caused d^Jay in "ant^riwg your letter of. the 31st ■ May. 2. "A town -board is a 'local authority' under ■the, Tramways Act, 1908, see sectiojfi 2, amended s 1911, section 4. The Town Board can construct its. own length" of tramway with the town 1 district, ■as a separate undertaking of its own, ori'can under clause 10 (1) of the " second schedule of the above Act, join with' the Borough m applying for an Ordeif-jn^ .Council empowering the, two "- local authorities to jointly construct and own the whole of the proposed tramway, i.e.,. the Borough extension to the Borough boundary, and the continuation of the tramway within the town district. 3. <v The Town Board can raise a loan for the construction of its own length of the line. (See Section Bof th© above Act.) After carrying its loan poll, the Town Board and the Borough could raise the two. loans as one joint loan under the Local Bodies Loans Act, 1913, Part II." 4. Clause 10 (2) of the said second, schedule' > contains provisions under which an order for a joint work can bo made notwithstanding the dissent of one of the local authorities concerned, provided, two-thirds, of the length of the proposed line are within the district of the local authority desiring the construction of the work."
