REINSURANCE CLAIM OF £5000

MELBOURNE, October 13, The Full Court reversed the Chief Justice's finding m the reinsurance claim of the National Mutual Life, and Australian Widows' Society. The -National Mutual Life Association insured a, p\an for ;£6OOO, and ■ reinsured Villi the Australian- Widows' Society. The man died, and the National Mutual office paid, the claim, and demanded from the Australian Widows' Society the reinsurance. The latter /refused to pay, on the grounds that the insured man's declaratioii; contained,. false statements. The, Chief Justice found that though some of the statements were false, the National' Mutual office acted reasonably and was honest m exercising its discretion m paying the claim. At the same time he entered judgment tfor the Australian Widows' Society, with costs. Tlie National ; office appealed, and the ..Full Court set aside the Chief Justice's finding, ahd entered judgment for the National >lutuaL».for £5000, with interest at the rate '6^ 4 per cent, and costs, '..v ; ■«
