- — — — .» — - (Per' Press Association.) AUCKLAND, last night In the Supreme Court Mr Justice Cooper gave judgment in a summons brought by J. N. Williams against the District Land Registrar, /Gisnorne, to show cause why he should not issue a certificate! of title under the Ltind Transfer Act in regard to the remainder of Kuangarehu block. The original block comprised 6878 acres, but 2478 acres were sold to the Crown, and at the siune time a transfer of the remainder from J. N. Williams to Herbert William Williams was effected. In regard to the balance of the land, the District Land Registiai registered a transfer, but declined to issue a certificate until the accuracy of tho survey was proved by another, as he believed the former survey to be incorrect. His Honor said it was clear that having issued, the original certificate the Registrar could not recall it. to correct an error in the description. Appellant had a clear statutory' right to a certificate for the balance, or, alternatively, in the- discretion of the Registrar, to liave handed to him the original certificate cancelled as to that portion of the land transferred to the Crown. He made an order for these terms, with £7 7s costs, to be paid by both parties out of the assurance fund. « — a— — — — ■ — ■
