MAGISTRATE'S COURT.

(Before Mr J. Booth, S.M.)

At the Magistrate's .Court this morning, lMr J. Booth delivered judgment in the ease of Bremner and others v. W. D. Lysnar, the hearing of which had occupied Ihe Court, two days last week. The claim was for the sum of £32 lCs 3d, and there was a counter claim for £02. His Worship disallowed £47 us of the counter claim, and gave judgment for the defendant for the difference between tho balance £44 15s, and the amount claimed by the plaintiff. Judgment was accordingly entered up for the defendant for £12 6s 3d. Mr Lysnar asked for costs, which His Worship could not see his way to grant. Mr Booth said the plaintiffs had lost the amount of their claim and more, and he could not grant costs against them. Mr Lysnar said his reason for asking for asking for co3ts was to show tho plaintiffs that they could not with impunity take contracts and throw them up whenever they chose. Costs of the Court amounting to £1 5s were allowed.
