WAVERLEY S.M. COURT.
SPECIAL SITTING. A special sitting of the Wavcrley j.M. Court was held on Wednesday be-, tore Mr, J. S. Barton, S.M., when the ollowing cases were dealt with: — LANDLADY AND TENANT. The Jirst case was a claim by Mrs. ,1. Howe against John Watt, fat stock uyer, for damages to her house. The /laiutilf claimed for electric bulbs, curaiu poles, a lemon tree, and three paslon fruit vinos, and damage done by .riving nails into the wall. The mag.'trate, in giving judgment for the pjaintilf, remarked that as to the light ■ albs no tenant could be held liable or them, and that it was not proved .hat the tenant had removed the poles, -iis Worship ordered the defendant to my £1 for removing the lemon tree -omplaincd of, on the grounds that a possessed no right to cut down uees on leased property. He, however, iclliued- to allow anything in respect ,-f the vines, which, he held, tho tenant ■tad a right to trim. As he ..^h eld that he tenant had acted unreasonably in driving large nails and staples into the nitchen walls, he ordered him to pay IDs damages therefor. Both litigants tppeared in person*.
NEIGHBOURS AT VARIANCE. Mr. Barton was then called upon to adjudicate upon a claim by R. G. Voul.airo (Mr. L. A. Taylor) against a icighbour, George Drydon (Mr, T. E. Roberts) for £5 for ploughing. The . easonabluuess of the charge made was ~ot disputed, but the defendant sought .o prove that the work was done foi ais employer, one Leslie Johnson. The magistrate, however, found that the defendant hud given the order for the work, and as he had not made it plain .hat the person liable was his employer and not himself, he was adjudged to pay the claim and costs £2
