CHARGE OF NEGLIGENCE DISMISSED. WELLINGTON, February 11. An echo of the fatality at the intersection of Cuba and Ghuznee streets on the cvenii of January 3 was heard in the Police Court, when Clarence Obreo Evans was charged with that by negligently driving a motor car he caused the death of Francis James Al'Kavanaugh. He was also charged with failing to give way at an intersection to a vehicle on his right. After hearing the evidence the magistrate said that looking at the facts broadly he did not think the cause of the man’s death was due so much to Evans not keeping on down the street in which he was driving as to the fact that the car which had the right of way insisted upon its right and accelerated. He did not think that a jury would convict on the evidence, and the indictable charge would be dismissed. On the lesser charge Evans was fined £5 and costs.
