ACCEPTANCE OF GIFT INVOLVED. WELLINGTON, July 12. The Court of Appeal is dealing this morning with the interpretation of a will matte on June 18, 1925, by William Branc Vater r'earce, deceased. Deceased was a farmer on a large scale in the Manawatu district, and owned 9041 acres in the Auckland district, as well as 416 in Wairarapa. On the Auckland property are stock and chattels valued at £11,203 14s. Deceased by his will devised 207 acres in the Wellington district to Robert B. Simpson, his manager, and his Auckland property, with stock and chattels, to his nephews, Frank Kenneth Pearce a. d Alan Pearce in equal shares, in March of this year the nephews gave notice that they refused to accept this land in the gift, but accepted the stock and chattels. The question arose whether a gift oan be accepted jn part and rejected for the other part, and an originating summons was issued for hearing at the Supreme Court at Palmerston North before Mir Justice Alpers. The parties agreed to remove the case direct to the Court of Appeal, and the matter *s now before the court to decide whether the gift must be either accepted or rejected in its entirety or whether it can be accepted as far as the personalty of the land is concerned and rejected as far as the land itself.

The question to be argued involves a matter of soiqe £70,000.
