LAND AGENT'S CONTRACT.

MR JUSTICE ADAMS’S WARNING. CHRISTCHURCH, July 24. Mr Justice Adams, in a case in the Supreme Court to-day, commented on the fact that in an agreement drawn up by Mr P. Best, land agent, on the sale of a house property there were the words “time is the essence of this contract.” His Honor asked a witness, Mr T. J. Sleeman, a land salesman employed by Mr Best, why those words were inserted. Witness said that they were in all MiBest’s but he did not know why. His Honor: Do you know that these words should not be inserted without an express agreement in such respect to them between the parties ? I have seen them in more Ilian one contract recently, and there seems to be a practice among agents of inserting them. They may involve most serious consequences in law actions. They should be inserted only when the parties clearly know what the legal effect: is.
